By accessing or using Design Maker AI, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using all parts of our platform, APIs, and generated assets.
To unlock full generation capacities, you must create a user account. You are responsible for keeping your credentials confidential and are fully responsible for all activities that occur under your account. You must notify us immediately of any unauthorized account access.
Certain premium capabilities are subject to subscription payments. Subscription fees are billed in advance on a recurring monthly or annual basis depending on your plan. All fees are non-refundable except where explicitly required by law or specified in our refund policy.
Any design assets, layouts, code, or images generated through Design Maker AI are owned by you (the User), subject to your compliance with these Terms. You grant Design Maker AI a non-exclusive, worldwide, royalty-free license to host, store, and display your generated designs solely for the purpose of presenting them to you and operational rendering.
You agree not to use the service to generate designs containing hate speech, harassment, illegal material, copyright-infringing content, or fraudulent copy. Automated scrapers, DDoS attacks, or reverse-engineering of our AI engines are strictly prohibited.
Our service is provided on an "AS IS" and "AS AVAILABLE" basis. Design Maker AI makes no representations or warranties of any kind, express or implied, as to the operation of the services or that generation output is free of mistakes or copyright claims.
In no event shall Design Maker AI, its directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform.
These terms are governed by and construed in accordance with the laws of the jurisdiction in which our corporate headquarters is located, without regard to conflict of law principles. Any dispute arising from these terms shall be settled via binding arbitration.
